3. Informational Nature and No Financial Advice
Khanh Phuvinh provides algorithmic tools, market data processing routines, and execution interface modules for digital assets, foreign exchange, and equity indicators. We are a technical infrastructure and analytics provider. We are not an authorized investment adviser, broker-dealer, portfolio manager, or financial services intermediary regulated by the Financial Conduct Authority (FCA).
All content, automated calculations, indicators, models, and platform metrics are provided strictly for educational and technological utility. Nothing on the Platform should be construed as financial advice, investment recommendations, tax planning, or solicitation to acquire or dispose of any asset.
4. User Accounts and Security
Where registration is enabled, you are responsible for maintaining the strict confidentiality of your credentials, authentication keys, and API tokens. You assume full legal responsibility for any activity conducted through your authenticated sessions. You agree to notify Khanh Phuvinh immediately upon learning of any unauthorized access, breach of credential integrity, or suspected system anomaly.
5. Intellectual Property
All proprietary source code, algorithmic logic, text, graphical interfaces, stylesheets, trade names, logos, and digital asset markers contained within the Platform are the exclusive property of Khanh Phuvinh or its respective licensors. Users are granted a limited, non-exclusive, non-transferable, revocable license to display and operate platform views solely for personal analysis. You shall not decompile, reverse-engineer, scrape, redistribute, or create derivative works from the Platform without prior written consent.
6. Disclaimers of Warranties
The Platform is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, statutory, or implied. To the maximum extent permitted under applicable law, Khanh Phuvinh disclaims all warranties including, but not limited to, merchantability, fitness for a particular purpose, non-infringement, continuous network uptime, execution accuracy, latency reliability, and error-free operation.
7. Limitation of Liability
To the fullest extent permitted by law, Khanh Phuvinh, its directors, officers, contractors, affiliates, and representatives shall in no event be liable for any indirect, incidental, punitive, special, or consequential damages, including loss of profits, loss of capital, trading deficits, slippage, system downtime, network forks, or data corruption, whether sounding in contract, tort (including negligence), or strict liability, arising from your reliance on the Platform.
8. Indemnification
You agree to defend, indemnify, and hold harmless Khanh Phuvinh, its officers, employees, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including legal fees) arising from your breach of these Terms, your misuse of the Platform, or your violation of any third-party right or applicable law.
9. Governing Law and Jurisdiction
These Terms, and any dispute or claim arising out of or in connection with their subject matter, shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. The courts of the United Kingdom shall have exclusive jurisdiction to settle any dispute or controversy arising out of these Terms.
